<p><strong>The Lacey Act needs your support</strong><strong>: <a href="http://bit.ly/K9fwj7" target="_blank">Sign the pledge</a> -</strong> The Lacey Act is a law that prohibits the import of illegally logged wood. It has successfully contributed to a 22 percent decline in illegal logging around the world and has saved a billion tons of carbon from being emitted. It stands as one of the most important forest protection and climate policies in the US and Congress members have stated that they are eager to hear from musicians on this issue.</p>
<p><strong>Specific ask for artists</strong>:</p>

Stay tuned &#8211; there is a lot that musicians can do to help amplify this campaign and this is just the beginning of a longer-term effort to educate fans and the public at large about this critical issue.</p>
<p><strong>How will the artist&#8217;s involvement help the larger campaign:</strong><br />
Not only does illegal logging lead to rainforest deforestation, climate change, species extinction and human rights violations but musicians have a special connection to this issue as illegal logging has been a critical force in driving many species of tonewoods, such as Brazilian Rosewood, to the brink of extinction.  Soon many of the woods we treasure for producing great sounding musical instruments will be extinct if we don&#8217;t stop illegal logging and ensure sustainable harvest of <a href="http://www.globaltrees.org/downloads/poster.pdf">these tonewood species.</a></p>

<p>Yauch also changed what it meant to be an artist-activist. I admit that when I met him, I was skeptical of him and his interest in my work (I was a human rights activist studying &amp; living with Tibetans in Nepal; he was the guy that sang &#8220;Fight For Your Right to Party&#8221;). But I quickly realized that he was an artist and an activist in the deepest sense of the words.<span id="more-2338"></span></p>
<p><img class="alignleft  wp-image-2342" title="Adam_photo" src="http://atctower.net/atc3/wp-content/uploads/2012/05/Adam_photo1-259x300.jpg" alt="" width="359" height="400" />In the years that followed, he didn&#8217;t just produce and perform at our concerts for Tibet. He also went to conferences and organized workshops. He was deeply strategic&#8211;most of the time&#8211;always passionate, and always welcoming. He believed in our team of inexperienced but determined 20-somethings, and our ability to do the impossible. And with that belief in us and in nonviolence, together we DID do the impossible. Never before has more fun been had while changing the world!!</p>
<p>Yauch&#8217;s work for Tibet helped jumpstart and nurture an international youth movement for Tibet and nonviolence&#8211;the best example of which can be found in <span style="color: #3366ff;"><a href="https://www.studentsforafreetibet.org/" target="_blank"><span style="color: #3366ff;">Students for a Free Tibet</span></a></span>, our sister organization and partner during all of the Tibetan Freedom Concerts. That this organization and movement is stronger today than when the last Concert ended is a testament to Yauch&#8217;s vision, leadership, and belief in young people.</p>
<p>As sad as we all are at his passing, it seems to me that the best way to honor him is to continue his work.</p>
<p>To all of the people who worked on, came to, or were moved by the Tibetan Freedom Concerts, let&#8217;s keep up the work that we started there and remember his words:</p>
<p><em>&#8220;i know we can fix it and its not too late</em><br />
<em> I give respect to King and his nonviole</em><em>nt ways</em></p>
<p><em> I dream and i hope and i won&#8217;t forget</em><br />

			</div>When a band or musician decides to raise money for a charity, there is a lot to think about beyond just the issue or organization to support. There are also legal considerations that differ by state and are intended to protect nonprofits from being taken advantage of by LLCs and other corporate entities These legal issues can be onerous and confusing. They are also often not known or addressed by bands and their managers who seek to raise funds for charity.</p>
<p>To streamline the information on compliance around raising money for charities, ATC has worked with Joe Voss, a lawyer at <a href="http://www.clarkhill.com/ArtistCauseCollaborations.aspx" target="_blank">Clark Hill’s entertainment division</a>, to create a checklist. Because some of these activities could be considered barriers to entry into charitable work, ATC has also created a suite of services that it can implement to take the work out of the hands of bands and their managers. <h4>CHARITABLE CHECKLIST FOR BANDS</h4>
<h5>STEP 1. WHO TO GIVE TO</h5>
<p>To come up with ideas of which issues you would like to support, it is best to first define the purpose and goal of the work and let that drive the tactics and beneficiaries that you choose. Here are some questions to ask in this process:</p>
<ul>
<li>Is there a particular issue that interests you (eg: energy/environment, peace, economic development, elections, net neutrality)? Are there any issues that you definitely donʼt want to support?</li>
<li>What is it about a particular issue that engages or enrages you? What hard lines on the issue do you draw?</li>
<li>Do you want to support an organization in a specific region or city, in each local tour stop, or a national or international organization?</li>
<li>Do you want the beneficiary to be service-oriented or activism-oriented?</li>
</ul>

<h5>STEP 2. HOW TO GIVE</h5>
<p>Ask the beneficiary(ies) to provide the following forms or data:</p>
<ul>
<li>A one-page description of the organizationʼs mission and work.</li>
<li>A copy of the tax-exempt determination letter from the IRS proving that the beneficiary is a 501(c)3 nonprofit that includes its tax id number.</li>
<li>￼￼￼A signed co-venture agreement (contact ATC if you would like a sample copy).</li>
</ul>
<h5>SPECIAL SCENARIO 1: ANNOUNCING THE DONATIONS</h5>
<p>If you are announcing the donations from benefit concerts or ticket add-ons before the money is raised, a formal co-venture agreement between the band and the nonprofit is required before the announcement. This agreement must be signed by two of the organization’s board members or officers, and needs to include:</p>
<ul>
<li>Agreement that the nonprofit be named as the beneficiary of the effort or event in press and other materials</li>
<li>Representation from the nonprofit that it is allowed to collect donations in that state (state solicitation registration) and that it is in good standing with the Attorney General of that state. (To be even more diligent, ask the nonprofit to provide a copy of the letter from the Attorney General proving this).</li>
<li>Indication that the band or promoter will pay out the proceeds from the effort or event within 90 days from the first announcement of the effort or event. (State law in places like California requires this).</li>
<li>￼Agreement that the nonprofit provide a written report to the band on the impact of the donation within a specific timeframe after the money is received.</li>
</ul>

<h5>SPECIAL SCENARIO 2: TICKET ADD-ONS</h5>
<p>If the effort includes ticket ad-ons, also follow these steps below:</p>
<ul>
<li>Include wording in promoter deal memos that contractually establishes the charitable add-on to each ticket (usually between $0.50 and $2). The wording should make it clear in the contact that the add-on is a charity donation that will be added on to the agreed-upon ticket price.</li>
<li>Agree that either the band or the promoter will receive the funds and then write the organization a donation check for the appropriate amount. Whoever is writing the actual checks will receive the letter of tax deduction. Please check with your business manager or tax accountant to determine the best way to proceed with this. If the promoter writes the checks, you will need to provide them with the IRS tax letter collected in Step 2.</li>
<li>Upon announcing the tour, the add-on and the beneficiary must be announced (via a press release, on the band&#8217;s website, etc.) The ability to opt out of this donation must also be announced. To do this, you can provide a URL to a dedicated page that indicates how to opt out. The fan should be directed to provide a copy of his or her ticket stub and drivers license as well as a stamped envelope and a signed note indicating that they purchased a ticket to the show and would like their $1 refunded to them instead of going to charity. This is extremely rare and done just for legal compliance; ATC has never been asked to refund a charity add-on. If you would like to implement add-ons for your tour but have note decided on a beneficiary yet, please contact ATC. We can receive the donation as part of the suite of services mentioned above.</li>
<li>Coordinate with tour manager to ensure that the correct amounts are written via check settlement, and written out to the correct beneficiary(ies). Also, if permitting the beneficiary to table, the tour manager will need to coordinate this. Please contact us for some tips on how to do this efficiently so as to not tax the already overworked tour manager.</li>
<li>If Artist needs to be reimbursed for any costs associated with the effort, costs must be reasonable and documented to the charity.</li>
<li>Mail the donation to the charity with a grant agreement letter stipulating that by cashing the check the beneficiary agrees to comply with local, state and federal laws and reporting requirements, which may include audits or reviews.</li>
</ul>

<p>The status of women’s rights in America is discouragingly similar to what is happening in other countries. In 2011, the rights of women in America continued its decade long decline after facing attacks on everything from access to health care to equal pay. Unfortunately, <a href="http://lmcintire.tumblr.com/post/18940752402/war-on-women-2012-a-primer" target="_blank">2012 has brought more of the same</a> as conservative pundits and lawmakers push to eliminate laws protecting battered women, outlaw birth control coverage, and gut public funding for public health organizations that are affiliated with abortion clinics (such as Planned Parenthood).<span id="more-2276"></span></p>
<p><img class="alignleft  wp-image-2287" title="map" src="http://atctower.net/atc3/wp-content/uploads/2012/04/map-300x174.jpg" alt="" width="300" height="174" />US legislation against access to birth control has been on the rise since 1995 and the number of states that are “hostile” to abortion rights <a href="http://www.guttmacher.org/pubs/gpr/15/1/gpr150114.html" target="_blank">has more than doubled</a> in the past decade. Much of the language in these bills across states is similar, indicating that this is a coordinated effort.</p>
<p>In February of 2012 came the Komen Foundation’s politicized decision to de-fund its support for Planned Parenthood’s cancer screening because of their policy to provide abortions. (Komen eventually apologized and re-instated the funding). In the midst of all of this, Congress called special hearings on access to birth control. <em>And, invited all men to speak on it.</em></p>
<p>The need for action to protect and expand the rights of women is impetrative.  While the upcoming election is vital to the outcomes of many of these attacks, much should be—and can be—done in the months until then, and musicians have a unique platform from which to help. <span style="text-decoration: underline;">Here are some recent examples of the ways that musicians are speaking out on the behalf of women’s rights:</span></p>
<p><img class="size-medium wp-image-2296 alignright" title="Morello_Rush" src="http://atctower.net/atc3/wp-content/uploads/2012/04/Morello_Rush-300x149.png" alt="" width="300" height="149" /></p>
<ul>
<li>After <a href="http://en.wikipedia.org/wiki/Rush_Limbaugh_%E2%80%93_Sandra_Fluke_controversy" target="_blank">Rush Limbaugh called birth control advocate Sandra Fluke</a> a “slut” and a “prostitute,” several musicians whose music had been used on Limbaugh’s program took to the media to voice their concerns. <a href="https://twitter.com/#!/tmorello/status/177956750375391233" target="_blank">Tom Morello tweeted</a>, <em>&#8220;Hey Jackass, stop using our music on your racist, misogynist, right wing clown show.” </em>Peter Gabriel and Rush also spoke out, issuing cease and desist letters to the show, stating Limbaugh had used their material without their permission. Musicians who find their music being used by individuals or groups they disagree with are put in a unique and powerful position where they are able to voice their disapproval and bring national attention to an issue they care about in a natural and very visible way.</li>
<li>When Susan G Komen for the Cure announced they were not planning on re-granting their annual $600k grant to Planned Parenthood, the Decembrists, who have been actively fundraising for breast cancer since band member Jenny Conlee struggled with her own bout of breast cancer last year, quickly <a href="http://decemberists.com/news/teamjennyfunds/" target="_blank">changed the beneficiary of their Team Jenny fundraiser</a> from Komen to directly fund Planned Parenthood’s Breast Health Emergency Fund. A move that speaks to the importance of vetting the organizations artists work with (ATC can help) and often looking for ways to give money to a direct service provider instead.</li>
<li>Other artists took to their social media accounts after the Komen decision: The Mountain Goats <a href="https://twitter.com/#!/mountain_goats/status/164499246211543040" target="_blank">warned their Twitter followers</a> that “Pro-choice musicians, know that Komen for the Cure is now on the side of the bad guys.”</li>
<li><a href="http://www.youtube.com/watch?v=x3Bik5pjptQ&amp;feature=player_embedded" target="_blank">Betheny Consentino of Best Coast</a> has been working over the last year to bring awareness to the issues Planned Parenthood is facing, putting together <a href="http://blogs.villagevoice.com/music/2011/06/best_coast_bethany_cosentino_planned_parenthood_interview.php" target="_blank">a benefit show in NYC</a> last summer for Planned Parenthood of New York City Action Fund, <a href="http://35denton.com/best-coast-warms-up-the-texas-way/" target="_blank">encouraging a crowd in Texas</a> to donate via text message and to, “Keep your rights as Texas women!&#8221; and <a href="http://pitchfork.com/news/45293-echo-chamber-best-coast-on-planned-parenthood/" target="_blank">taking to her Facebook page</a> with support after Komen pulled funding for Planned Parenthood.</li>
</ul>
<p><strong><span style="text-decoration: underline;">What Musicians (you!) Can Do</span></strong>:</p>
<ul>
<li><strong>Talk about the issue</strong>. Use whatever methods you are comfortable with (public appearances, interviews, shows, social media) to call attention to aspects of this issue that speak to you. If a group or organization you oppose uses one of your songs, don’t back down!  Use it as an opportunity to voice your opposition, and to hold them accountable. <li>If you’re touring, <strong>pay attention to local aspects</strong> of the War on Women. For instance, Wisconsin is passing some of the worst laws for women. If you are going there, speak out on it.  ATC can help you understand the geography of these laws and also help you partner with local organizations.</li>
<li><strong><em>Register your fans to vote</em></strong>. You can do this in many ways: remind people to register at your shows, on your website or via social media, team up with voter registration organizations for voter reg at your shows (<em>but be sure to mention their presence from the stage</em>) or produce content encouraging voter registration to put in your fan newsletters. <li><strong>Stay in touch</strong>. When K’naan heard from his fans that Mitt Romney was using his song, “Wavin’ Flag”, he invoked trademark law arguing that Romney was damaging his brand. In a recent <a href="http://www.nytimes.com/2012/02/04/arts/music/romney-and-gingrich-pull-songs-after-complaints.html" target="_blank">New York Times article</a>, K’naan explained: “I’m for immigrants. I’m for poor people, and they don’t seem to be what he’s endorsing. My song being his victory song didn’t seem quite right.”

<p><em></em>Ann Powers spelled out the basics of music and copyright law in her NPR story, <a href="http://www.npr.org/blogs/therecord/2012/02/29/147592568/music-in-political-campaigns-101" target="_blank">Music In Political Campaigns 101</a>. This is a must read for political operatives <em>before </em>they finalize campaign playlists.</p>
<p>And ATC asked our election law experts for the quick and dirty on what artists should do when they (1) want to donate a song to a campaign for use or, (2) stop a campaign from using a song:</p>
<h4><strong>USE OF RECORDED MUSIC BY CAMPAIGNS</strong></h4>
<p><strong></strong><strong><em>Campaigns you support:</em></strong></p>
<ul>
<li>Of course the artist can waive performance royalties for use of music by a particular campaign / organization, by filing an appropriate waiver with the PRO.</li>
<li>Don’t assume though that campaigns and political parties and organizations have any idea that they need to get a license from the PRO unless they get a waiver from the artist. Most of them aren’t aware of how this works and frequently get in trouble with the PRO’s.</li>
<li>If you find out that your music is being used by a campaign or organization you support, you should decide whether you want to waive or enforce performance royalties—and if the former, you should contact them about ensuring that a proper waiver is filed.</li>
</ul>
<p><strong><em>Campaigns you oppose:</em></strong></p>
<p>If a campaign or organization (SuperPAC, nonprofit, political committee) that you oppose is using your music in advertising, on its website and/or at rallies and public events:</p>
<ul>
<li>You can shut down the unauthorized performance of your music by having the relevant PRO contact the campaign or organization and demand that back royalties be paid and that the campaign/organization cease and desist from using your music without a proper license from the PRO.</li>
<li>You can contact the opposing campaign or organization directly and make the same demand and/or publicize the issue as you see fit.</li>
</ul>
